Subpoenas and Legal Information Requests
Revised March 12, 2024
This page provides information for those seeking user data from Brex Inc. or its affiliates (collectively, “Brex”) via a subpoena or other legal information request (e.g., a warrant from a law enforcement agency). When Brex receives legal requests for user data, we review them carefully and work diligently to handle them in accordance with applicable law. Any information requests that are not legal in nature should be directed to Brex’s Support team.
Addressing Your Legal Information Request
The Brex entity to which you should address your legal information request depends on the Brex product to which your inquiry pertains. For example, Brex Inc. is not a bank but works with bank partners to issue corporate credit cards. It also offers expense management services to interested corporate customers.
- If your inquiry relates to the Brex Card product or to the expense management services, you should address your legal information request to Brex Inc.
- If your inquiry relates to the Brex business account product (accounts that allow customers to sweep uninvested cash balances into certain money market mutual funds or FDIC-insured bank accounts) or the bill payment feature, you should address your information request to Brex Treasury LLC.
- If your inquiry relates to both the Brex Card and Brex business accounts, you should address your request to both Brex Inc. and Brex Treasury LLC.
Serving Your Legal Information Request
Brex expects all legal information requests it receives to comply with applicable laws and rules, including those governing how the request must be served. You may serve Brex Inc. and Brex Treasury LLC in California through their registered agent, Corporation Service Company, at the following address:
Corporation Service Company d/b/a CSC - Lawyers Incorporating Service
2710 Gateway Oaks Drive, Suite 150N
Sacramento, CA 95833
You may also serve the Brex entities identified above through their identified registered agent for service of process in various other states where a registered agent is authorized to accept legal process on their behalf. The best way to identify a registered agent, if applicable, who is authorized to accept legal process in a particular state is to perform a business entity search on the website of the governmental entity in that state who maintains a record of businesses registered with the state (in many states, either the Secretary of State or Division of Corporations).
We kindly request that you serve any subpoenas or other legal information requests on the registered agent for the entity to whom your request is directed. This helps ensure that your request will be received and routed to the correct personnel for handling in the most efficient and timely manner. If you wish, you may also send a courtesy copy of your subpoena/request via email to notices@brex.com to help minimize any delay in our response to your request. Please note, providing a courtesy copy via email alone will not constitute proper service on Brex or its affiliates. We appreciate your cooperation.
Responding to your request
Please identify in your request an email address or other electronic means we may use to provide any information that may be responsive to your request. This will help us to expedite a response to your request in the most cost-effective and efficient manner.
